1. The Relationship Between Dinbilauktion.dk and Users


1.1 About Dinbilauktion.dk

Dinbilauktion.dk is a physical platform that acts as an auctioneer and provides a marketplace for buying and selling cars. The platform does not participate as a party in the transactions but provides the auction system for buyers and sellers. All transactions made on Dinbilauktion.dk are binding for both parties, and the platform has no responsibility for individual transactions. All auctions are conducted under the authority of an auctioneer appointed by the Ministry of Justice.


1.2 User Categories and Rights

Individuals and businesses can register as users on Dinbilauktion.dk. Rights and obligations vary depending on the user category. Dinbilauktion.dk reserves the right to refuse registration, change user categories, or close a user account at any time with immediate effect.


1.3 Registration of Cars

All users can register cars on the platform, provided they own the car and are responsible for ensuring that all information is complete and accurate. For businesses, employees authorized by the company may also register cars.


1.4 Description of the Car

Registered cars must be described accurately according to the applicable guidelines. All known faults and deficiencies must be disclosed. When a car is registered, the description is binding for the seller and cannot be changed without contacting Dinbilauktion.dk.


1.5 Reserve Price

The seller determines a reserve price in consultation with Dinbilauktion.dk. If a bid meets or exceeds the reserve price, the seller is obliged to sell. Dinbilauktion.dk rejects customers with unrealistic pricing.


1.6 Course of the Auction

Dinbilauktion.dk manages the course of the auction, including start and end times, and can make changes along the way. All auctions are conducted under the supervision of an auctioneer appointed by the Ministry of Justice.


1.7 Bidding Rules

All bids are binding. If the bid reaches the reserve price or higher, a binding agreement is made, and bids cannot be withdrawn. Maximum bids are allowed without being present during the auction, either via email or in person. In the case of multiple registered maximum bids, the highest bid wins over the second-highest maximum bid. Once the sale is confirmed with the hammer strike, the buyer must immediately report to the podium, present valid identification, show their personal QR code, and pay a deposit according to the Fee/Price List. Any disputes regarding bids will be concluded definitively and bindingly by Dinbilauktion.dk.


1.8 Fee Rules

When a transaction is completed via Dinbilauktion.dk, both the buyer and the seller are obliged to pay a fee according to the Fee/Price List, regardless of whether the transaction is completed or not. The fee is binding and must be paid on the auction day. The auction fee is independent of the bid amount and is paid directly to Dinbilauktion.dk.


1.9 Disclaimer

Dinbilauktion.dk takes no responsibility for the execution of transactions between the buyer and the seller and disclaims any responsibility for technical errors and operational disturbances. No compensation is provided for indirect losses.


1.10 Processing of Personal Data

Personal data is treated confidentially and only shared when necessary. Anonymized data may be used for marketing and analysis.


1.11 Governing Law and Jurisdiction

Transactions and relations on Dinbilauktion.dk are governed by Danish law, and any legal disputes will be handled by the District Court in Kolding. Should Dinbilauktion.dk become liable for damages, compensation claims cannot under any circumstances, and regardless of the extent of the loss, exceed 5,000 DKK.

Dinbilauktion.dk reserves the right to correct any typographical or written errors in the documentation.


2. The Relationship Between Buyer and Seller


2.1 Introduction – Dinbilauktion.dk as Auctioneer

Dinbilauktion.dk does not participate as a party in the transactions and serves solely as a facilitator. Disputes between the buyer and seller must be resolved by the involved parties. The fee is not affected by whether the transaction is completed.


2.2 Payment for the Car

After the hammer strike, payment for the car must be made on the same day via bank transfer, as Dinbilauktion.dk does not accept cash. Once the payment is registered, the car's documents and a receipt will be issued, after which the buyer will have the right to use the car. However, the right only takes effect once the full purchase price is received.


2.3 Transfer of Risk

The risk for the car transfers to the buyer upon handover/final payment.


2.4 Basic Obligations of the Seller

The seller must ensure that the car meets the description and is free from liens and other third-party rights. Any encumbrances must be settled before handover; alternatively, any lien holder must approve the transaction in writing.


2.5 Basic Obligations of the Buyer

Once the buyer has won the auction, they are obliged to accept the car and pay the purchase price. If the buyer discovers discrepancies between the car's actual condition and the seller's description, the buyer has the right to cancel the transaction entirely. This right is valid up to a maximum of 2 hours after the hammer strike or a maximum of 1 hour after full payment, and this only in consultation with our automotive expert. However, this does not affect Dinbilauktion.dk's right to the fee.


2.6 Disputes Between Buyer and Seller

Disputes must be addressed according to Danish law. The parties are encouraged to seek legal advice in the event of disagreements and should not be represented by the same attorney.


2.7 The Vehicle Document and Liens on the Car

The seller is responsible for ensuring that the car is free from liens and liabilities at the time of transfer.


2.8 Reservation of Errors

Dinbilauktion.dk reserves the right to correct any typographical or written errors in the documentation.
