1. Relationship between Dinbilauktion.dk and the Users

1.1 About Dinbilauktion.dk

Dinbilauktion.dk is a physical trading platform acting as auction holder and providing a marketplace for the purchase and sale of various types of vehicles and goods, including but not limited to cars, caravans, trailers, motorhomes, mobile construction equipment, towed boats, and other auction items, hereinafter referred to as “catalogue numbers”, under the rules of auction law governing public auctions.

The auctioneer is obligated to take out a guarantee insurance to ensure settlement with the consignor in accordance with the Auctioneer Act.

Dinbilauktion.dk does not participate as a party in the transactions and cannot in any way be held liable for the transaction, the auction item, or any consequences thereof. All transactions concluded at Dinbilauktion.dk are binding for the buyer and the seller, also referred to as the “consignor”, and the platform bears no responsibility. All auctions are conducted by an auctioneer appointed by the Ministry of Justice and in accordance with auction legislation.

All items are sold in the condition in which they are found at the fall of the hammer, without liability for the auctioneer or the auction holder. No warranty or right of complaint is provided, and there is no responsibility for the functionality or legality of the catalogue number’s condition. Any claim for damages must be directed towards the consignor. Dinbilauktion.dk does not carry out functional tests of the catalogue number.

Note: These terms and conditions are designed to ensure a fair and transparent auction experience for all parties at Dinbilauktion.dk.

1.2 User Categories and Rights

Private individuals and companies may register as users on Dinbilauktion.dk. Rights and obligations vary depending on the user category. Dinbilauktion.dk reserves the right to refuse registration, change a user’s category, or close an account at any time with immediate effect.

1.21 User Validation

All users are required to validate themselves with MitID via the platform in order to submit valid bids. Upon request, the auctioneer may demand documentation for a validated user and may, in cases of doubt, refuse to accept bids from non-validated users.

Immediately after achieving the highest bid at deferred sale or the fall of the hammer at sale, the user is obligated to contact Dinbilauktion.dk to confirm and complete the transaction by paying the deposit, commission, and bid amount.

The auction area is under video surveillance for the purpose of documenting bidders and securing/providing evidence of catalogue numbers’ damages or theft. Users must accept that Dinbilauktion.dk stores recordings for as long as necessary for documentation. It is not permitted for users to record video in the auction area.

1.3 Registration of Catalogue Numbers

All users may register catalogue numbers on the platform, provided they are the legal civil owner of the catalogue number, hereinafter referred to as the “consignor”. The consignor is responsible for ensuring that all information is complete and correct. For companies, employees authorised by the company may also register catalogue numbers.

Documents accompanying a catalogue number, e.g. the registration certificate if the catalogue number is a vehicle, must be available at the time of registration and always no later than 2 hours before the auction begins. If such documents/registration certificates/certificates etc. are provided later than before the auction, this will be stated in the catalogue with the text “Documents/registration certificate to follow”. The buyer must then accept up to 30 days processing time. After this, the buyer has the right to cancel the purchase with the consignor regarding the bid amount but not the commission to Dinbilauktion.dk.

Consignors requiring documents to be provided later will be charged an additional fee according to the Commission/Pricelist.

In cases where no documents are included, such as registration certificate, COC, customs papers, etc., the catalogue will state “No registration certificate/documents included” and the buyer is obligated to obtain these independently without the consignor’s involvement.

The auctioneer determines the order of catalogue numbers in the catalogue and will, to the greatest extent possible, conduct the auction in catalogue number order. The auctioneer will announce when deviating from the order. Catalogue numbers may be auctioned and sold directly from the parking lot adjacent to the auction hall without being physically presented inside the hall.

1.4 Description of the Catalogue Number

Registered catalogue numbers must be described accurately, and the responsibility lies solely with the consignor. All known faults and defects must be stated. Once registered, the description is binding for the seller and may not be changed without contacting Dinbilauktion.dk.

The consignor decides which classification the catalogue number belongs to, but the auctioneer reserves the right to downgrade the classification.

1.5 Reserve Price

The seller, in cooperation with Dinbilauktion.dk, sets a reserve price. If the bid matches or exceeds the reserve price, the seller is obligated to sell. Dinbilauktion.dk rejects catalogue numbers with unrealistic pricing.

A catalogue number may be registered for a maximum of two auctions from the same consignor in accordance with the law.

1.51 Duties, Taxes, and VAT

The catalogue number may be subject to duties, taxes, and VAT in addition to the bid amount. The consignor is obligated to provide correct information and remains responsible after the sale for the accuracy of the information given regarding taxes, VAT, and duties. The buyer has the right to cancel if the consignor has provided incorrect information.

Information on any taxes, VAT, and duties will appear in the catalogue description of the catalogue number.

1.6 The Auction Process

Dinbilauktion.dk manages the auction as auction holder. All auctions are conducted under the leadership of an auctioneer appointed by the Ministry of Justice. The auctioneer is also appointed as collector in accordance with the Auctioneer Act and the Instructions for Auctioneers.

1.7 Bidding Rules

All bids are binding. If a bid meets or exceeds the reserve price, a binding agreement is entered into, and bids cannot be withdrawn.

The auctioneer determines minimum bids and increments. For most catalogue numbers, bids are placed in increments of DKK 1,000.

It is possible to submit binding advance bids without attending the auction, in accordance with the Commission/Pricelist. This must be done no later than 2 hours before the auction via email or in person. Where several maximum bids are registered, the highest takes precedence over the second-highest.

When a sale is confirmed by the fall of the hammer, the buyer must immediately report to the podium, present valid ID, show their personal QR code, and pay a deposit in accordance with the Commission/Pricelist.

Any disputes regarding bids are settled finally and bindingly by the auctioneer.

Deferred sale:

The auctioneer may declare “deferred sale” if the reserve price has not been met. The bidder is then bound by their bid for 2 hours, during which Dinbilauktion.dk contacts the consignor for potential acceptance of the bid below the reserve. If the bid is accepted, the catalogue number is re-announced and then sold at the fall of the hammer without further overbids. If the bid is not accepted, the catalogue number remains unsold.

Anyone bidding on behalf of another assumes joint and several liability as guarantor, and there is joint liability for those bidding together.

1.8 Commission Rules

When a sale is concluded at the fall of the hammer via Dinbilauktion.dk, both buyer and consignor are obligated to pay commission according to the Commission/Pricelist, regardless of whether the transaction is completed or subsequently cancelled. The commission is binding and must be paid on the auction day. The auction commission is independent of the bid amount and is paid directly to Dinbilauktion.dk.

1.9 Disclaimer of Liability

Dinbilauktion.dk assumes no responsibility for the completion of transactions between buyer and seller and disclaims any liability for technical errors and operational disruptions. Dinbilauktion.dk cannot be held liable for indirect losses such as: loss of business, loss of time, loss of profit, data loss, or other forms of indirect loss.

1.10 Processing of Personal Data

Personal data is treated confidentially and only shared when necessary to complete transactions. Anonymised data may be used for marketing and analysis.

1.11 Governing Law and Jurisdiction

Transactions and matters on Dinbilauktion.dk are subject to Danish law, and any legal proceedings shall be brought before the Court in Kolding. Should Dinbilauktion.dk be held liable for damages, claims cannot under any circumstances, regardless of the size of the loss, exceed DKK 5,000.

1.12 Reservation for Errors

Dinbilauktion.dk reserves the right for typographical and printing errors in the catalogue.

2. Relationship between Buyer and Seller

2.1 Introduction – Dinbilauktion.dk as Auction Holder

Dinbilauktion.dk does not participate as a party in transactions and acts solely as intermediary. Disputes between buyer and seller must be resolved between the parties. The commission is unaffected by whether the transaction is completed or subsequently cancelled but is payable upon the fall of the hammer.

2.2 Classification of the Catalogue Number

At registration, the consignor categorises the catalogue number. Dinbilauktion.dk performs no tests of the catalogue number, and all information regarding cosmetic condition, technical condition, legality, and prior use is solely the responsibility of the consignor.

In cases of incorrect categorisation and any subsequent cancellation, the consignor must pay both buyer’s and seller’s commissions.

All complaints must be submitted in writing to Dinbilauktion.dk at info@dinbilauktion.dk no later than 1 hour after payment, provided payment was made within 1 hour of the fall of the hammer. If payment is not completed within this time frame, the right to cancellation lapses. In exceptional cases, the auctioneer may waive this rule.

2.3 Payment for the Catalogue Number

After the fall of the hammer, payment for the catalogue number must be made the same day via bank transfer. Dinbilauktion.dk does not accept cash. Once payment is registered, the documents relating to the catalogue number as stated in the catalogue and a purchase receipt will be handed over, after which the buyer has the right of disposal over the catalogue number. This right only takes effect once full payment has been irrevocably received by Dinbilauktion.dk.

2.4 Transfer of Risk

The seller is responsible for the catalogue number before and during the auction, as well as after the auction if it is not sold. Risk transfers to the buyer upon transfer/final payment. Dinbilauktion.dk cannot at any point be held liable for the damage or loss of the catalogue number.

2.5 Consignor’s Fundamental Obligations

The consignor must ensure that the catalogue number matches the description and is free of mortgages and third-party rights. Any encumbrances must be cancelled before transfer, or the lienholder must approve the transaction in writing with confirmation of cancellation.

The seller must not contact potential buyers directly to complete a transaction outside of Dinbilauktion.dk. All transactions must take place via the platform to ensure a fair and transparent auction process. Violation may result in exclusion from future auctions as well as potential legal liability for damages etc. The auctioneer may grant exemptions in special cases.

2.6 Buyer’s Fundamental Obligations

When the buyer has won the auction, they are obligated to accept the catalogue number and pay.

If a vehicle requiring registration is purchased with license plates, it must be re-registered by the buyer before delivery can take place. Alternatively, proof of deregistration must be provided.

The buyer has the right to cancel the transaction if the actual condition of the catalogue number deviates significantly from the assigned classification – see classifications. The right of cancellation applies up to 1 hour from payment, provided payment is made no later than 1 hour after the fall of the hammer. It is solely the auctioneer who decides whether the catalogue number deviates from the classification. This does not affect Dinbilauktion.dk’s right to commission.

2.7 Disputes between Buyer and Seller

Disputes must be handled under Danish law. The parties are encouraged to seek legal counsel in case of disagreement and should not be represented by the same lawyer.

2.8 Registration and Encumbrances in the Catalogue Number

The consignor is responsible for ensuring that the catalogue number is free from liens, debts, and encumbrances upon transfer. If a lienholder has approved a sale against later cancellation of the lien, the catalogue will state “Processing time for lien cancellation”, and the buyer must accept up to 6 months processing time. Dinbilauktion.dk will not settle with the consignor until all liens are cancelled, unless the consignor is the Enforcement Court, an estate administrator, trustee, or another authorised seller in a public capacity.

2.9 Reservation for Errors

Dinbilauktion.dk reserves the right to correct any typographical errors in the catalogue in connection with the auction.

3. Storage of Catalogue Numbers at Dinbilauktion.dk

All catalogue numbers are stored without responsibility for Dinbilauktion.dk. It is the consignor’s responsibility to ensure insurance coverage. Therefore, Dinbilauktion.dk provides the following security measures:

  • Security Group 20: Our facility is approved under Security Group 20, which means it meets the highest requirements for physical security against burglary and theft.

  • Key Cabinet CSN 750V: An approved key cabinet type CSN 750V ensuring keys are stored in a locked and secure unit, protected against theft and fire.

  • Key Drop Cabinet GN 1: An approved key drop cabinet type GN 1, allowing keys to be delivered securely without direct staff contact.

It is the consignor’s responsibility to contact their insurance company to confirm insurance coverage during storage at Dinbilauktion.dk. Likewise, it is the buyer’s responsibility to confirm coverage from their own insurance after the fall of the hammer.

Sold catalogue numbers must be collected no later than 2:00 p.m. the day after the fall of the hammer.

Catalogue numbers left beyond this deadline will incur a parking fee according to the Commission/Pricelist per catalogue number per day. Uncollected paid items will be resold without notice after 2 months, with proceeds used to cover parking fees and administrative costs.

Unsold catalogue numbers must be collected by the consignor no later than the day after the auction. Catalogue numbers left beyond this deadline will incur a parking fee according to the Commission/Pricelist per catalogue number per day.

Classifications

At registration, the consignor categorises the catalogue number into one of the following categories. Dinbilauktion.dk performs no tests, and all information about cosmetic condition, technical condition, legality, and prior use is solely the responsibility of the consignor.

Category A

The catalogue number is free from significant faults and defects, meaning all central functions such as engine and gearbox (if the catalogue number is a vehicle) work. For example, defective air conditioning is not considered a significant fault or defect if the catalogue number is a vehicle. There must be no major mechanical or technical defects affecting usability. Wear parts cannot be claimed. For Category A, all reported operating meters (hour meters, engine hours, odometers, etc.) are the responsibility of the consignor, and the buyer has a 1-month right of return against the consignor if it can be proven that the reported operating meters were incorrect at the fall of the hammer.

Category B

The catalogue number is generally free from significant faults and defects, but specific circumstances noted in the catalogue prevent an A classification. Wear parts cannot be claimed.

For Category B, all reported operating meters (hour meters, engine hours, odometers, etc.) are the responsibility of the consignor, and the buyer has a 1-month right of return against the consignor if it can be proven that the reported operating meters were incorrect at the fall of the hammer.

Category UK – Unclassified Catalogue Numbers

Catalogue numbers with this classification are sold without any right of complaint and often include items from forced sales, estate administrators, bankruptcy estates, enforcement courts, etc. Reported operating meters (hour meters, engine hours, odometers, etc.) are provided without responsibility and may be inaccurate, which the buyer must accept.

For all classifications, catalogue numbers sold for a bid amount of DKK 10,000 or less carry no right of complaint or cancellation.

For all classifications, bidders are reminded that an extended duty of inspection applies at physical auctions. It is therefore recommended to thoroughly review the description and visually inspect before bidding, and to consider consulting external experts.

All movement on the auction premises, parking areas, and access roads is at one’s own risk.

Items may not be removed from the site before payment.

All theft or attempted theft will be reported to the police.
